EULA - End User License Agreement

WELCOME TO PILGWAY LIMITED!

PLEASE READ THE AGREEMENT CAREFULLY. BY INSTALLATING OR USING THIS SOFTWARE YOU AGREE WITH ALL TERMS OF THIS AGREEMENT. YOU AGREE THAT THIS AGREEMENT IS EQUIVALENT OF THE USUAL LEGAL CONTRACT BETWEEN YOU AND PILGWAY LIMITED ( below PILGWAY) AND YOURS ACCEPTING OF THIS AGREEMENT IS EQUIVALENT TO PUTTING OF YOURS SIGNATURE TO THIS AGREEMENT. THIS AGREEMENT HAS LEGAL EFFICACY. IF YOU DO NOT WISH TO ENTER INTO THIS AGREEMENT PLEASE PRESS THE 'I DO NOT AGREE' BUTTON DURING THE INSTALLATION AND DO NOT USE THIS SOFTWARE.
THIS AGREEMENT GIVES YOU NON-EXCLUSIVE LICENSE TO USE THE SOFTWARE ON THE TERMS OF THIS AGREEMENT. YOU DO NOT HAVE ANY RIGHTS IN THE SOFTWARE. ALL RIGHTS IN THE SOFTWARE ARE OWNED BY PILGWAY LIMITED.

1. DEFINITIONS

Pilgway's software products: 3D-Brush demo version, 3D-Brush Home version and 3D-Brush Professional version are referred to below as the "Software" as well as all connected documentation provided to you by Pilgway.

1.1 If you press 'I agree' button during the installation you will enter into this Agreement in the capacity as a Demo version User as of the date that you press the button.

1.2 If you enter right serial number which Pilgway sends to you after the payment for the 3D-Brush Professional version and press 'Continue' button in the registration form during the registration you will enter into this Agreement in the capacity as a Professional version Purchaser as of the date that you press the button 'Continue'.

1.3 If you enter right serial number which Pilgway sends to you after the payment for the 3D-Brush Basic version and press 'Continue' button in the registration form during the registration you will enter into this Agreement in the capacity as a Basic version Purchaser as of the date that you press the button 'Continue'.
2. LIMITATION ON THE COMPUTER'S NUMBER

2.1 You may install and use Demo version of the 3D-Brush on any numbers of computers.

2.2 You may register and use one copy of the 3D-Brush Home version only on one computer.

2.3 You may register and use one copy of the 3D-Brush Professional version only on one computer.
3. INTELLECTUAL PROPERTY OWNERSHIP

3.1 The Software are the intellectual property of the Pilgway Limited . The Software is protected by international copyright laws.The code of the Software are the valuable trade secrets of Pilgway Limited.

3.2 Any Pilgway's shopmarks, logos, trade names, domain names and brands are the property of Pilgway.

4 RESTRICTIONS

4.1 The 3D-Brush software should not be used in the production of any lewd or obscene materials as well as of any products which propagandize hatred against people. We understand that we are not able to check you, this is on your conscience, but we warn you about responsibility before God.

4.2 You may not attempt to extract the source code of the Software by disassemble or any other means.

4.3 You may not use demo version and home version of the Software in commercial purposes for your profit.
5. DISCLAIMER

PILGWAY LIMITED PROVIDES THE SOFTWARE AS-IS WITH ALL DEFECTS AND
FAULTS. PILGWAY DISCLAIMS ALL WARRANTIES TO ANY MATTER. PILGWAY IS NOT LIABLE TO YOU FOR ANY LOSS, DAMAGE OR DETRIMENT. THIS CLAUSE OF THE AGREEMENT IS VALID ANY TIME AND IT WILL APPLY EVEN IN THE BREACH OF THE AGREEMENT.
6. CONFORMITY TO THE LICENSE

Pilgway has authority to make request to you concerning observance of this agreement. You agree to provide Pilgway within 40 days with all documentation that confirms yours conformity to licenses from Pilgway.
7. PERIOD OF VALIDITY

7.1 In the case of yours compliance with the license the agreement is valid during the period of Software's use.

7.2 Pilgway break off the agreement if you infringe any terms of it. In this case you agree to destroy all copies of the Software on your computer and do not use it . In this case Pilgway is not liable to you.
